Please find below the most recent guidance issued by CBP regarding the forthcoming USTR Section 301 tariffs. Local CBP offices are generally providing consistent direction, in line with the guidance circulated by the New Orleans region noted below.
 
Pursuant to Federal Register Notice (FRN) titled “Notice of Action and Proposed Action in Section 301 Investigation of China’s Targeting the Maritime, Logistics, and Shipbuilding Sectors for Dominance” published on April 17, 2025, with modifications published on June 12, 2025, Annexes I, II, and III establish new fees for vessels owned, operated, or built in China, and for all foreign-built vehicle carrier vessels.
 
The burden for determining if a vessel owes the fee is on the operator, NOT CBP.
