Barring an unlikely last-minute delay, the controversial USTR Section 301 Vessel Fees will take effect, tomorrow: October 14, 2025.
 
Despite strong industry pushbackโ€”including from Moran Shipping and other U.S. maritime stakeholdersโ€”implementation proceeds which means ๐˜€๐—ต๐—ถ๐—ฝ ๐—ผ๐—ฝ๐—ฒ๐—ฟ๐—ฎ๐˜๐—ผ๐—ฟ๐˜€ ๐—ป๐—ฒ๐—ฒ๐—ฑ ๐˜๐—ผ ๐—ฝ๐—ฟ๐—ฒ๐—ฝ๐—ฎ๐—ฟ๐—ฒ ๐—ป๐—ผ๐˜„.

The Office of the U.S. Trade Representative (USTR) is imposing new port entry fees on vessels:
โžค Owned or operated by Chinese entities
โžค Built in China (regardless of ownership)
โžค Foreign-built vehicle carriers (Ro-Roโ€™s)

The fees are collected by the Pay.Gov website -but- calculated and paid by the vessel operator.

๐—ช๐—ต๐—ผโ€™๐˜€ ๐—”๐—ณ๐—ณ๐—ฒ๐—ฐ๐˜๐—ฒ๐—ฑ?
If your vessel arrives from foreign waters and must file formal CBP entry (19 U.S.C. ยง 1434), the fees apply.

EXEMPTIONS INCLUDE:
โžค Vessels that lighter cargo offshore
โžค Calls made only for bunkering/stores
under certain conditions
โžค LNG tankers (vessel type 132) are
completely exempt
โžค Annex II vessels meeting certain specs:
โ€“ Under 4,000 TEUs, 80,000 DWT (bulk),
or 55,000 DWT (other)
โ€“ Voyages under 2,000 NM from furthest
foreign port
โ€“ Arriving in ballast (no cargo or pax)

โ€ข Annex I (Chinese owned/operated): $50/NT
โ€ข Annex II (Chinese built): $18/NT
โ€“ Capped at 5 voyages per fiscal year
โ€ข Annex III (foreign-built Ro/Roโ€™s): $46/NT
โ€“ Modified from $14/CEU as of Oct 10th
โ€“ Capped at 5 voyages per fiscal year

โ€ข All payments via Pay.gov using the
Section 301 Fee Payment Form
โ€ข Must be made 3 business days prior to
arrival at the first U.S. port from abroad
โ€ข ACH from U.S. bank accounts onlyโ€”
foreign banks must route through U.S.
correspondent accounts
โ€ข Confirmation email must be forwarded to
the vessel agent as proof for CBP entrance
๐Ÿ’ก Note: You need your International Carrier Bond (ICB) number to pay.

โ€ข Fees apply at the first U.S. port onlyโ€”not
every stop
โ€ข โ€œVoyage distanceโ€ is calculated from the
furthest foreign port, not the last port
before the U.S.
๐Ÿ“Example: A Chinese-built ship loading in Singapore, then calling Mexico before arriving Oakland, would be charged based on the Singapore origin.

โžฃ Regulatory uncertainty remains, but
implementation is moving forward.
โžฃ We urge all stakeholders to prepare as
though these fees are permanent.
